A report by Becker News states that Texas’ Heartbeat Law has beaten a challenge from Biden.
Biden’s Justice Department filed a lawsuit against the Heartbeat Law, which prohibits abortions after six weeks of pregnancy.
Robert Pitman, United States District Judge, denied a request from the Biden administration to stop the law from being enforced during the course of the lawsuit.
Judge Pitman acknowledged that the law debate is complex and stated that both sides should have the opportunity to present their case.
“This case presents complex, important questions of law that merit a full opportunity for the parties to present their positions to the Court,” stated Judge Pitman.
The Obama-appointed judge, however, did not think that the law should remain in place while the lawsuit is being filed.
The statement read: “In reaching this conclusion, we stress that we do not purport to resolve definitively any jurisdictional or substantive claim in the applicants’ lawsuit,”
“This order is not based on any conclusion about the constitutionality of Texas’s law, and in no way limits other procedurally proper challenges to the Texas law, including in Texas state courts.” stated the judge.
A Mississippi judge is set to hear a case next month to determine whether Roe v. Wade merits are satisfactory for the state.
